    Man Charged With Naming Dog Buhari

    Mr Joachim Fortemose Chinakwe, a forty-year-old textile trader, based in Ogun state was arrested on the 13th of August for naming his dog after President Buhari.

    He was arrested after one of his neighbours of Hausa extraction complained that he named the dog after his Father.

    He was arraigned on the 23rd of August before the Ota Magistrate court where he was charged with committing an offence likely to cause a breach of peace.

    Actions Taken

    Mr Joachim Fortemose was arraigned before an Ota Magistrate court and charged with conducting himself in a manner likely to cause a breach of peace. under Section 249 (d) of Criminal Code of Laws of Ogun State of Nigeria, 2016. He was granted bail to the tune of N50, 000 and one surety. His case was adjourned to November 21.

      Section 39 of the 1999 Constitution of Nigeria give people freedom of the right to expression. As there has been no sections in the Nigerian constitution that criminalizes animal naming rights, It is quite apt to say that the fundamental rights of expression was breached by virtue of his arrests and detention. Mr Joachim Fortemose was unlawfully arrested and detained as his action does not have any locus standi in the Nigerian constitution.
